1. GENERAL PROVISIONS
1.1. This Policy determines the procedure for processing and protecting personal data of individuals (hereinafter referred to as Users), which can be obtained by the Operator when Users use the sites fenix-gsm.com and fenix-gsm.ru
1.2. The Policy was developed in accordance with Federal Law No. 152-FZ dated July 27, 2006 “On Personal Data” (as amended in 2025) and is the Operator’s policy regarding the processing of personal data within the meaning of Art. 18.1 of the said law.

1.4. Consent to the processing of personal data is drawn up in a separate document — Consent to the processing of personal data — and is not part of this Policy, agreement or offer.

2. COMPOSITION OF PERSONAL DATA
2.1. The Operator can process the following User data:

Last name, first name, patronymic;
Email address (e-mail);
Phone number;
Account login and password;
Telegram ID (when linking an account);
Data necessary for the provision of services and software configuration (IP address, device specifications, device identifiers);
Information about orders and payments (without storing full bank card details);
Cookies and data from analytical systems (Yandex.Metrica, etc.).

2.2. The operator does not process special categories and biometric personal data. Full bank card details are not collected or stored by the Operator — payments are processed by certified payment providers.

3. OBJECTIVES AND LEGAL BASIS OF PROCESSING
3.1. Provision of services and execution of the contract (Public Offer) — basis: clause 5, part 1, art. 6 152-FZ (execution of an agreement to which the subject is a party).
3.2. Contact with the User, sending confirmations and payment receipts — basis: execution of the contract and requirements of the legislation of the Russian Federation.
3.3. Analytics of actions on the site and cookies to improve the quality of services — basis: separate consent of the User.
3.4. Compliance with the requirements of the legislation of the Russian Federation — basis: law.

4. PROCESSING PROCEDURE AND PROTECTION
4.1. Processing is carried out in a mixed way (automated and non-automated).
4.2. Recording, systematization, accumulation, storage, clarification and retrieval of personal data of citizens of the Russian Federation is carried out using databases located on the territory of the Russian Federation(Part 5 of Article 18 152-FZ). Cross-border transfer of personal data is not carried out.
4.3. Processing period: until the purposes of processing are achieved or until the User withdraws consent, unless another period is provided by law.
4.4. The operator takes the necessary legal, organizational and technical measures to protect personal data from unauthorized access, destruction, modification, blocking and other unlawful actions, and also maintains procedures in case of incidents (leaks) in accordance with legal requirements.

5. PROCESSING ORDER AND RECIPIENTS
5.1. The operator has the right to entrust the processing of personal data to third parties on the basis of a contract and on confidentiality terms (Part 3 of Article 6 152-FZ), to the extent necessary to fulfill the order:

payment services — for processing and returning payments;
persons who ensure the operation of the site (hosting, technical support);
web analytics services — in the amount of anonymized data on visits.

5.2. The operator does not sell personal data or transfer it to third parties for independent purposes, except in cases expressly provided by law (at the request of authorized government bodies).

6. RIGHTS OF THE SUBJECT OF PERSONAL DATA
6.1. The user has the right to: receive information about the processing of his data; demand clarification, blocking or destruction of data that is incomplete, outdated, inaccurate or unlawfully obtained; revoke consent to processing; appeal the Operator’s actions to Roskomnadzor or in court (Article 14 152-FZ).
6.2. To exercise his rights, as well as to withdraw consent, the User sends an application to the address admin@fenix-gsm.com. The procedure and consequences of withdrawal of consent are determined by Consent to the processing of personal data.

7. COOKIES AND ANALYTICS
7.1. The site uses cookies and web analytics systems to ensure the operation of the site and improve the quality of services. By continuing to use the site, the User agrees to the use of cookies. The user can disable cookies in the browser settings.

8. POLICY CHANGE
8.1. The operator has the right to make changes to this Policy. The current edition is always posted on this page and comes into force from the moment of publication.
